These Terms govern your use of the iPhone app "Blushnote" with its widgets ("the App"), published by Eduard Bruch, Kleinfeld 28c, 21149 Hamburg, Germany ("we", "us"). They apply in addition to Apple's Licensed Application End User License Agreement (Standard EULA), which is the licence under which you use the App. If these Terms and the Standard EULA conflict, the Standard EULA prevails. Our Privacy Policy explains how we handle personal data.

1. What the App is

Blushnote connects two people. After you pair your account with your partner's, you can answer a daily question together, play question packs, send notes and photos that appear on each other's lock and home screens, share your distance, count down to your next visit and keep a shared journal. Some features are free; others need Premium (Section 5).

2. Your account

You need to be at least 16 years old to use the App, and 18 or older to switch on the "After dark" pack. You sign in with Sign in with Apple, Sign in with Google or with your email address. Keep access to your Apple ID, Google account or email secure; you are responsible for what happens in your account. One account can be paired with one partner at a time.

3. What you share

Everything you write, upload or send in the App (answers, notes, photos, messages, journal entries) stays yours. You give us the non-exclusive, free, worldwide right to store, process, resize and deliver it to you and your partner, only as far as needed to run the App, for as long as it is stored. Your partner can see and keep what you share with them, including by exporting it; shared journal entries stay with your partner if you unpair or delete your account.

Only share what you have the right to share. Don't use the App to harass, threaten, spy on or pressure anyone, to share sexual content involving minors or anyone without their consent, or for anything illegal. Location sharing must always be voluntary for both of you; never turn it on for someone else. We may suspend or delete accounts that break these rules.

4. Fair use

Don't attempt to access other people's data, overload or attack our servers, reverse-engineer the App beyond what the law allows, or get around limits on free features.

5. Premium (auto-renewing subscription)

Premium unlocks every pack and game, unlimited notes to each other's lock screens, unlimited journal photos and memories, scheduled notes, more than one countdown, the full answer archive and sending photos to the home screen at any time. One Premium subscription covers both partners of a paired couple; your partner pays nothing.

Prices in other countries are shown in your local currency in the App and in the App Store before you buy; the price shown at purchase applies. There is no free trial.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically for the same period at the then-current price unless it is cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage and cancel the subscription in iOS Settings → your name → Subscriptions, or in the App under Us → Premium → Manage, on the iPhone (Apple ID) that bought it. Only the buyer can cancel. After cancelling, Premium stays on for both of you until the end of the period you paid for.
• If Apple changes the price of a subscription, Apple informs you and, where required, asks for your consent before renewal.
• If you unpair, each of you keeps Premium until the end of the period already paid; after that, the subscription continues for the buyer only.
• Deleting your account or the App does not cancel a subscription.

6. Streak repairs (one-time purchases)

A streak repair brings back your shared streak after missed days (1, 2, 3, 4 or up to 7 days, each a separate one-time purchase at the price shown in the App). It is applied right after purchase and used up; either partner can buy one for the couple. Repairs are only offered for gaps the App says can be repaired.

7. Payments, refunds and right of withdrawal

All purchases are processed by Apple under the App Store's terms. Refunds and, for consumers in the EU, the statutory right of withdrawal for digital content and services are handled by Apple: reportaproblem.apple.com. If something doesn't work after you paid, email support@blushnote.app and we'll help.

8. Changes to the App

We keep improving the App and may change, add or remove features. We will not remove a core part of Premium during a period you already paid for without offering a reasonable alternative. The App needs an internet connection to sync; we aim for high availability but cannot guarantee it at all times.

9. Ending

You can stop at any time: Us → Data → Delete account deletes your account (see the Privacy Policy for what is deleted). We may end or suspend your account for serious or repeated breaches of Section 3 or 4, and will tell you why unless the law prevents it. If we ever shut the App down, we will announce it at least 60 days in advance in the App, so you can export your data.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an obligation that is essential for the App to work and on which you may rely (cardinal obligation), limited to the damage typical and foreseeable for this kind of app. Otherwise our liability for slight negligence is excluded. The App is a tool for staying close; distance and "arrived" information can be delayed or inaccurate and must not be relied on for safety or emergencies.

11. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you live. If you are a merchant, the place of jurisdiction is Hamburg, Germany.

12. Changes to these Terms

We may update these Terms, for example when features or the law change. We will inform you of material changes in the App at least 30 days before they apply; if you don't agree, you can delete your account before then. The date at the top shows the current version.
